Bankruptcy

The economic climate that we are now experiencing has devastated many through job loss or reduction in income and benefits.  This has been exacerbated by increasing prices for living necessities.  Those who once paid their bills in a timely fashion and were able to save, now see their savings depleted by unmanageable debt.  It is not an easy decision to file bankruptcy, but we hope to provide our clients with an appreciation that bankruptcy can provide a fresh start and relief from undue economic stress and hardship.

Chapter 7, otherwise known as "liquidation" or "straight bankruptcy" is available to individuals, married couples, corporations, and partnerships. It is generally the quickest way to declare bankruptcy. However, it is a serious and complicated legal undertaking and is not a cure for every financial problem that an individual may have.  Our Office is well versed in the undertaking of such a procedure. For example, we understand that in a Chapter 7 bankruptcy, many types of unsecured debt are legally discharged by the bankruptcy proceeding; however, we also know there are various types of debt that cannot be discharged. Common exceptions to discharge include child support, income taxes less than 3 years old, property taxes, student loans, criminal fines, and restitution imposed by a court.
